1. This agreement
These terms are a contract between you and Daniel Lima, an individual trading as Vyral, based in Vancouver, British Columbia, Canada. "Vyral", "we" and "us" mean Daniel Lima. "You" means you, the creator. Our Privacy Policy forms part of this agreement.
By creating an account or using Vyral you accept these terms. If you don't accept them, don't use Vyral.
2. Who can use Vyral
You must be at least 18, able to enter a contract, and own or be authorised to post from the social accounts you connect. One person, one Vyral account — you can connect several social accounts to it.
3. Your account
Keep your login details secure; you're responsible for what happens under your account. Keep your information accurate, especially your payout details — we're not responsible for money sent to a PayPal address or wallet you entered incorrectly.
Before you can earn, you must verify each social account you post from. TikTok uses TikTok's own sign-in; Instagram uses a code placed in your bio.
4. You are not our employee
You take part as an independent contractor. Nothing here creates employment, partnership or agency. You decide what to make and when to post, you use your own equipment and accounts, and you're responsible for your own taxes. Payments are gross. No amount of work is promised.
5. Campaigns and submissions
Each campaign carries a brief — the sound to use, what the post must include, what's off limits. Read it before you film; most rejections are a post that ignored one line of it.
Campaigns have limited budgets and can close, pause or run out at any time, including after you've started. Post to your own account as normal, then submit the link in the app. Keep the post up — if you delete, archive or hide it, views stop counting and unpaid earnings on it are forfeited.
Campaign content, including artist names, artwork and sounds, belongs to the brand or artist. Your licence to use it covers making a post for that campaign and nothing else.
6. Review is ongoing
We review every post against the brief when you submit it, and again while the campaign is running. A post that was approved and earning can be rejected later if it stops meeting the brief, if its metrics turn out to be inflated, or if it breaches these terms. You'll be notified with a reason. A rejection on one post doesn't affect your others.
7. How you earn, and when you're paid
Every campaign pays one of two ways, shown on the campaign itself:
- Per view — you earn on every view the post gets. Rates are quoted per 100,000 views for readability; earnings accrue on each view, not in blocks.
- Per post — a flat fee once the post is approved.
Views are counted from the platform's own public metrics. Those numbers are the platform's, not ours — if they're revised, your earnings are adjusted to match. Earnings accrue only while a post is approved and live, and only up to the campaign's remaining budget.
Approved earnings are paid within 7 days of a campaign closing, to the PayPal address or Solana wallet on your profile. Until they're sent, earnings show as pending — an estimate, not a debt owed to you, and subject to adjustment if metrics change or a post is later rejected.
8. Crypto payouts
If you choose crypto, we pay in USDC on the Solana network only. Anything else won't arrive. Blockchain transactions are irreversible — funds sent to an address you entered incorrectly, or on another chain, are permanently lost, and we're not liable for them. Transactions are public and permanent. We are not an exchange, broker or wallet provider, and we don't give investment advice; USDC is a payment rail here, nothing more.
9. Your content
You keep ownership of everything you make. We claim no ownership of your posts.
By submitting a post you grant us and the brand behind that campaign a limited, non-exclusive licence to view the post, track its public performance, and reference it in reporting to that brand. That is the full extent of it — this licence does not allow anyone to repost your video, edit it, or use it in advertising. Any such use would need your separate agreement.
You confirm you have the rights to everything in your post beyond what the campaign itself provides.
10. What gets you removed
- Buying, botting or otherwise inflating views or engagement. This removes the whole account, not just the post, and forfeits unpaid earnings.
- Submitting someone else's video, the same video twice, or a post made before the campaign went live.
- Connecting a social account you don't own or control.
- Deleting, archiving or hiding a post after submitting it.
- Ignoring the brief — wrong sound, or the right sound cut too short to recognise.
- Posting anything unlawful, hateful, harassing, sexually explicit, or infringing someone's rights.
- Creating multiple accounts, evading a ban, or interfering with our systems.
11. Ending your account
You can delete your account at any time from Profile → Delete account. Unpaid earnings are forfeited when you do — wait for your balance to be paid before deleting.
We may suspend or terminate your account if you breach these terms, if we reasonably suspect fraud or artificial engagement, or if the law requires it. Where we can, we'll tell you why and give you a chance to fix it. If we terminate for fraud, unpaid earnings are forfeited; for any other reason, we'll pay out earnings already approved.
12. Third-party platforms
Vyral isn't affiliated with, endorsed by or sponsored by TikTok, Instagram, Meta, PayPal or Apple. Using those services means following their terms as well as ours. If a platform changes its API or restricts access, some features may stop working, and we're not liable for that.
The Vyral app, website, brand and design are ours. Don't copy, resell or reverse-engineer them.
13. No guarantee, and limits on our liability
Vyral is provided as is. We don't guarantee that campaigns will be available, that your post will be approved, that it will get any particular number of views, or that you'll earn any particular amount. Anything you've seen about typical earnings is illustrative, not a promise. We don't guarantee the service will be uninterrupted or error-free.
To the fullest extent the law allows, we're not liable for indirect or consequential loss, lost profits or lost opportunity. Our total liability to you for any claim is limited to the greater of the earnings we paid you in the preceding six months, or $100.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't lawfully be excluded. You'll cover us against claims arising from your posts or your breach of these terms.
14. Disputes and governing law
Talk to us first — [email protected]. Most disputes are a misunderstanding about a rejection, and we'd rather fix it than argue about it.
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there, and the courts of British Columbia have exclusive jurisdiction.
15. Changes
We may update these terms. The date at the top will change, and we'll notify you in the app or by email before material changes take effect. Continuing to use Vyral after that means you accept them. If you don't, delete your account.
If any part of these terms is unenforceable, the rest still applies. You may not transfer this agreement; we may transfer it as part of a sale or reorganisation of the business.
